Sexual & Gender-based Violence as a Weapon of War During the October 7, 2023 Hamas Attacks

As time goes on, a fuller picture of what transpired during Hamas’ October 7, 2023, assault on the communities of the Gaza Envelope is beginning to emerge. It is becoming more apparent that the violence perpetrated against women, men, and children also included widespread sexual and gender-based crimes. While the full scale of the assault is yet to be uncovered, we consider it essential to present the information currently known to us. We have chosen to do so for several reasons. First and foremost, to encourage the reporting and documentation of these severe violations of international humanitarian law and fundamental moral principles, to advocate for international condemnation and sanctions against the perpetrators, and to prevent their recurrence. Secondly, to support the survivors and those who will hopefully still survive. Social and institutional recognition of the experiences of survivors is crucial to their capacity to describe what they endured. We hope that providing such recognition also promotes the allocation of social, professional, and financial resources to facilitate the conditions for their healing. Lastly, the publication of this position paper aims to bring attention to the urgent need to release the hostages still being held in Gaza. Those among them who endured or witnessed sexual and gender-based crimes face a higher risk of experiencing further violence and neglect while being denied vital physical and mental medical care. The increased danger to their well-being compels us to utilize all available means to promote their release from captivity and safe return.

Position Paper: The Harming of Medical Personnel and Facilities During the October 7, 2023 Hamas Attacks

One prominent aspect of the attacks carried out by Hamas on October 7, 2023, was the assault on medical personnel and facilities, during which emergency teams were prevented from reaching the wounded, while some of those attempting to provide care were killed. The evidence available to us through media reports and other public sources indicates that these actions must be investigated as war crimes. Given that the armed conflict inside the Gaza Strip is still ongoing, any attacks on medical personnel and facilities and attempts to prevent them from carrying out their duties within this context remain outside the scope of this report - and will be addressed separately. Physicians for Human Rights Israel (PHRI) is currently engaged in protecting health workers and patients in Gaza and does not have immediate access or resources to collect testimonies and carry out adequate inquiries. Therefore, the subject of this report is limited to outlining the violations committed by Hamas on October 7, 2023. In doing so, we separately address attacks on hospitals and clinics and attacks on emergency medical personnel and vehicles.

There is war in Gaza again. At this time, it seems like heavy smoke is covering the area, the media, consciousness, and the entire future. But one thing can be already stated with certainty: the casualties of this war have already paid the price. Its dead have already died; its wounded will go on to contend with the pain and trauma for the rest of their lives. As health and medical professionals, Jews and Arabs, our position is no more moral than that of anyone else, but by dint of our positions and our ongoing work, our point of view is different.

Physicians for Human Rights-Israel: All Measures Must Be Taken to Avoid Injuring Medical Personnel and Endangering Medical Facilities and Teams While Fighting Continues in the Gaza Strip

In light of many cases of damage to hospitals, clinics, and medical personnel in the Gaza Strip, Physicians for Human Rights-Israel has sent an urgent communication to the Attorney General and to the Minister of Defense. Yesterday, Physicians for Human Rights-Israel (PHR-IL) sent a letter to the Attorney General and the Defense Minister of Israel, addressing the harming of medical facilities and medical teams, and the difficulties of evacuating casualties in the course of the Gaza military operation.

A Procedure to Evacuate Those Injured in the Gaza Strip is Required Immediately

Reports were received of damage to Al Wafa Rehabilitation Hospital in Sejaiya. According to media reports rockets were stored in a building near the hospital, which was bombed later. Inside the hospital at the time were 17 patients in serious condition (for whom evacuation presents a real danger to their condition), staff and international activists.
